In the UK, the "right to roam" is not "presumed"-it is a settled issue-and a class issue, because before that right was established and codified after concerted and effective mass protest, camping out in the British wilds-most of which were and owned by various dukes and lords...generally because they stole them from the Celts and the Picts and whoever may have been there before those peoples-was a luxury refused to the aristocratic few.
