And given how things were in the 18th century, can anyone really say that the work of justices like Ginsberg, Marshall, Douglas and Warren, in setting things right, is invalid? Where would we be as a country if nothing had ever happened besides what the Federalist and Democratic-Republican Parties wanted in 1800? And why shouldn't we see the enshrinement of slavery in the Constitution and the preservation of Jim Crow for almost a century after abolition as anything BUT right-wing and reactionary?
